irrlicht is "just" your engine.. you have to use external level-editors (like 3dstudio, milkshape, ...)

i use anim8or it is free and easy to use it exports 3ds so the engine can load its files
milkshape is good if you want to create animated models that work in irrlicht
and 3dstudio is good if you have money, time to learn it, and want the ability to have alot of advanced functionality

the best part of using 3ds, obj, ms3d, bsp, and md2 is that there is alot of stuff freely availible including tutorials so the learning curve for the engine is less :D

The formats are not copyrighted, what are copyrighted are the tools.

So you you can not use ID tools for make content but you can make your own tools that write md2, md3, bsp or whatever.

i think using for example ID software tools should not be a problem in case of the license

most likely it won't cause a problem as long as the use is not comercial
i believe if it is comercial then you have to pay for a liscense
