My graphics card: Ati Radeon HD3850.
The while loop works well in glsl so I thought that this is caused by hlsl but
I will try it with enabled vsync.

lol you are using the wrong method for ray intersection dude!!!

there was one when you go back and forward untill you get within a reasonable distance between the collision point

That's called a binary search. Cone stepping is another alternative to a linear search.
